Terms of Service

1These terms

Fondaco (“Fondaco”, “we”, “us”) provides advisory and set-up services for people and businesses operating across borders. These terms are the agreement between you and us for anything you book or buy from us. If you do not agree with them, do not book or buy.

We may update these terms. The date at the top of this page always reflects the current version, and where a change materially affects your rights we will tell you before it takes effect.

2Who provides the services

This website is provided by Atlas Nexus LLC, Sharjah Media City, United Arab Emirates, which operates within an international group of companies. The information on it is general guidance.

When you book a consultation, an action plan or any other service through this website or a connected website, your contracting party is the company named in the order form or at checkout, and that company’s terms apply. Atlas Nexus LLC is not necessarily that company. Which company provides a service should be clear from the context and from the order form. If it is not, write to info@team.fondaco.co before you book.

3Eligibility

You must be at least 18 years old to book or buy from us. If you buy for a company, you confirm that you are authorised to act for it.

4What we provide

• Consultations — a 60-minute call on your situation. We prepare before the call, give you our recommendations on it, and send you a written summary afterwards.
• Action plans — in-depth research into your situation, a written plan, and several calls to go through it, for the fixed price shown before you pay.
• Implementation — carrying out a plan for you: formations, accounts, applications, bookkeeping and filings. The scope and the price are agreed with you in writing before the work starts.
• Services — fixed services such as company formation, ITIN applications and US addresses. What each one includes, what we need from you and how long it usually takes are set out on its page on this website.

Filings that need a licensed professional in the country concerned are carried out by one we work with.

When you continue from a consultation to an action plan or implementation, or from an action plan to implementation, the fee you paid for the earlier level is credited toward the later one.

5What we need from you

Our work depends on what you tell us. You agree to give us accurate and complete information, to tell us when something changes, and to send only documents that are genuine and belong to you or to someone you are authorised to act for. Where information is wrong or missing, the result can be wrong too, and we are not responsible for that.

6Not legal or tax advice

Fondaco is not a law firm or an accounting firm. Our consultations, action plans and published guides are general information and structuring guidance. They are not legal, tax, accounting, investment or immigration advice, and they do not create a professional relationship of that kind.

Rules change, and they apply differently depending on where you live. Before you act on a decision with legal or tax consequences, confirm it with a qualified professional in the country concerned. You remain responsible for your own compliance with the laws that apply to you.

7Third parties decide

Government agencies, registries, banks, payment processors and platforms make their own decisions. We cannot guarantee that a company is registered, an ITIN is issued, an account is opened or an application is approved, or how long any of it takes. Timelines on this website describe what usually happens. They are not a promise.

8Prices and payment

Prices and any applicable tax are shown at checkout before you pay. Where a service is priced on request, we confirm the price with you before any work starts.

Payment is handled by third-party payment providers. We do not store your full card details.

9Services billed yearly

Services billed yearly, such as a US address, renew automatically at the end of each year using the payment method on file, until you cancel.

You can cancel at any time by writing to info@team.fondaco.co. The service then runs to the end of the year you have already paid for, and does not renew after that.

10Consultations

After paying for a consultation, you choose a time on the booking page and answer the questions on the booking form. We use your answers to prepare, so the more detail you give, the more of the call goes on your situation.

11Refunds

Fees are non-refundable once paid, including for the rest of a year when you cancel a yearly service part way through.

There are 2 exceptions. If we decline work you have paid for before we have started it, we refund you. And if you were charged twice, charged after cancelling, or charged an amount you did not agree to, write to info@team.fondaco.co and we will put it right.

12Declining or stopping work

We may decline work, or stop it, if the information you give us is false, if the work would be unlawful, or if sanctions or the checks of the banks and professionals we work with prevent it.

13The website

We work to keep this website and its checkout running, but we do not promise uninterrupted access. The website and its content are provided on an “as is” and “as available” basis, without warranties of any kind, to the fullest extent permitted by law.

14Liability

To the fullest extent permitted by law, our total liability to you for any claim arising out of or relating to our services is limited to the amount you paid us in the 12 months before the claim arose.

We are not liable for indirect or consequential loss, or for lost profits, lost opportunities, tax liabilities, penalties or professional fees, including any arising from decisions you took in reliance on our recommendations or on information we publish.

15Governing law

These terms are governed by the laws of the United Arab Emirates, without regard to their conflict of laws rules. The competent courts of the United Arab Emirates have exclusive jurisdiction over any dispute arising from them.
